Joint Training on Legal Aspects of Trade Negotiations
Joint Training on Legal Aspects of Trade Negotiations was help during 27-28 October 2016 at Vang Vieng, Vientiane Province. The Training was chaired by Mrs. Kingsadone Phetdaoheuang, Deputy Director General of the Department of Foreign Trade Policy (FTPD) and presented by Ms. Cherise Valles, Deputy director of the Advisory Centre on WTO Law and Mr. Martin Molinuevu, Senior Trade Policy Specialist from the World Bank. This training was co-organized by the Department of Foreign Trade Policy, Ministry of Industry and Commerce under the support of the Second Trade Development Facilities (TDF II), the World Bank and the Advisory Centre on WTO Law.
The objective of this training is to build capacity for the government staff specially to build the capacity on negotiations and treaty legal drafting and interpretation focusing on principle of treaty interpretation; formulation of trade law obligations and identifying the deference between mandatory endeavor language. On the treaty, legal drafting and interpretation terms the presenter introduced about the legal value of exceptions, reservations interpretative notes and side documents.
In additional, the workshop also introduced on the scheduling of concessions and commitment in services and investment in both positive and negative lists as well as the legal issues of the WTO accession including protocols of accession as source of rights and obligation in the WTO and WTO disputes involving the interpretation of acceding WTO Member’s Schedule. At the end of the workshop, the participants together practiced on drafting some exercise.
